How does the Pocket Manchester Reverse Auction work
Unlike a traditional auction where the highest unique bid made by an entrant becomes the purchase price, in a reverse auction it’s the lowest unique bid made that becomes the purchase price. To enter the Pocket Manchester Reverse Auction, simply text the keyword such as BID followed by the amount in pence to 86300. The bid must be between 1p and 9999p. To have the auction item purchased for your bid price, text the bid that you think will be the unique lowest bid.
For example: BID 260 if you think the lowest unique bid will be £2.60p.
Who can enter the Auction?
Anyone over 18 can enter the auction. Entrants must own or be authorised to use the mobile phone that texts an auction bid.
What information will entrants receive?
Entrants will be sent an initial text message confirming the status of their bid. Entrants will also be sent a text message if the status of their bid changes. The status of a bid can be one of the following:
- NOT UNIQUE
- UNIQUE BUT NOT THE LOWEST
- UNIQUE AND THE LOWEST
An example message is shown below:

If a bid is NOT UNIQUE or UNIQUE BUT NOT THE LOWEST, entrants can use their skill to bid a different amount so their a bid is UNIQUE AND THE LOWEST. A £1.50 entry fee is charged for each bid. Each entrant is allowed a maximum of 20 bids per day and 100 bids per auction.
How is the winning bid decided?
The following lists twenty bids received at the end of the first day of a sample Reverse Auction. The 12th bid (Bid-12) received for 5p is currently the UNIQUE AND THE LOWEST bid received.

What happens if another entrant bids the same amount after I have made a UNIQUE AND THE LOWEST bid?
If you have a UNIQUE AND THE LOWEST bid and someone else bids the same amount then your bid is no longer unique. In the above example list, if a new 21st bid was received for 5p the status of the 12th bid changes from UNIQUE AND THE LOWEST to NOT UNIQUE and if you had made the 12th bid, a free of charge text message similar to the following would be sent to your mobile phone:

Can my UNIQUE bid become the UNIQUE LOWEST bid?
Yes, in the above list after receipt of the 21st bid of 5p, if you previously had the 15th bid (BID-15) of 6p, your bid would now become the current UNIQUE AND THE LOWEST bid and a free of charge text message similar to the following would be sent to your mobile phone:
Congratulations your bid of 6 pence is now the lowest unique bid.

Can my UNIQUE AND THE LOWEST bid become a UNIQUE BUT NOT THE LOWEST bid?
Yes, in the above list, if a new 21st bid was received for 4p, the 12th bid of 5p that was previously UNIQUE AND THE LOWEST would become UNIQUE BUT NOT THE LOWEST, and a free of charge text message similar to the following would be sent to your mobile phone:
Your bid of 5 pence is still unique but no longer the lowest unique bid.

How much does each entry to the auction cost?
The cost of entering a bid in the auction is £1.50p plus your standard network rate. Once the text containing the bid confirmation is received on your mobile phone, your account is automatically debited by £1.50 and your bid becomes valid. If for any reason you do not receive a bid confirmation you will not have been charged and your bid is considered invalid. Note that the auction is NOT a subscription service and billing can only be invoked by you sending a text message to the auction.
What happens if your auction entry message contains mistakes?
If you do not type in the keyword correctly before the bid amount or if you make a mistake with the bid amount you may still be charged if the bid amount is valid. If you enter a keyword correctly but enter an invalid bid amount you might not be charged and will be sent a free of charge text message similar to the following:
Your bid amount was invalid. You have notbeen charged for thismessage.

When does the auction close?
The auction closes at 1200 noon on 31st October 2009. If a bid is received after this date and time you will receive a free of charge text message similar to the following:
Your bid was received after the closing date and time. You have notbeen charged for this message.

What happens if there are no unique bids when an auction closes?
If there are no unique bids received when an auction closes, the winner is the entrant who first entered the lowest bid received.
How many bids can I make?
A £1.50 entry fee is charged for each bid. You can make up to 20 bids per day and up to 100 bids per auction. If you exceed your daily or total auction number of bids you will receive a free of charge text message similar to the following:
Your bid was not accepted as you have exceeded your maximum number of bids.

This reverse auction service (”the Service”) is operated by ONESOON Ltd. (”ONESOON”) whose registered office address is 17 King Street, Knutsford, Cheshire, WA16 6DW on behalf of Pocket Manchester (”Auction Provider”). By activating a request to use the Service (”Service Request”), or receiving a response from the Service (”Service Response”), whether originally requested by yourself or someone else you acknowledge that you (”the Customer”) accept these Terms and Conditions.
Definitions
- “Mobile Network” means the mobile celluar phone network operated by the Customer’s mobile phone operator.
- “Mobile Phone” means a celluar phone handset used to send and receive text messages connected to the Mobile Network.
- “Service Request” means a user of the Customer’s mobile phone sending a text message to activate the Service.
- “Service Response” means the Service sending one or more text messages to the Customer’s mobile phone following a Service Request.
- “the Service” means the receipt of service requests from the Customer, the processing of those requests and the provision of data related to those requests back to the Customer.
- “Customer” means you, the person that sends or receives text messages to and from the Service.
- “Service Charge” means the cost of the Service charged to the Customer’s mobile phone account or deducted from calling credit.
- “Third Party” means any organisation whose has products that are offered to a Customer by the Service.
- “Auction Provider” means any organisation, client or agency whose provide items for purchase by Customers using the Service.
Conditions of use
- The Customer must be over 18 years of age.
- The Customer must be the owner or legitimate user of the Mobile Phone.
- If the Customer is not the mobile phone bill payer, the Customer must get permission from the bill payer before using the Service.
- The Customer must not use the service fraudulently or in connection with any criminal offence.
- The Customer must not use the service to send any material which is obscene, menacing, defamatory, abusive, offensive or in breach of any person’s rights.
- The Customer must not use the service to send unsolicited promotional material or spam.
- The Customer acknowledges that the accuracy, quality and completeness of the Service data may depend on the mobile phone on which the message is received. It is the Customer’s responsibility to check that all requests to the Service are handled satisfactorily on the receiving mobile phone. All requests regardless of result will constitute a successful use of the Service and the Customer will be charged for all Service Requests.
- The Customer acknowledges that the accuracy, timeliness, quality and completeness of the Service may depend on circumstances outside OneSoon’s control. The Customer agrees to indemnify ONESOON, and its subsidiaries, affiliates, officers, and employees, from any claim or demand, made by the Customer or any third party due to or arising out of data ONESOON transmits from the Service.
- The Customer acknowledges that in addition to the Service Charge, the Customer may be charged a standard operator network charge for any messages sent or data received as part of the Service Request. These costs will normally be charged to the Customers mobile phone bill if a contract account, or will normally be deducted from a calling credit if a pre-paid account.
- The Customer acknowledges that submission of incorrect Service Requests will still incur a Service Charge. The Customer will not be refunded under any circumstances.
- The Customer shall be solely responsible for the data content of any message, which ONESOON receives, transmits or processes on the Customer’s behalf or on behalf of any third party associated with the Customer. The Customer agrees to indemnify ONESOON, and its subsidiaries, affiliates, officers, and employees, from any claim or demand, made by any third party due to or arising out of data content the Customer transmits to the Service.
- The Customer acknowledges that, by definition, access to the mobile cellular network and other communication networks and media is associated with risks including but not limited to authentication, data security, privacy, availability of services, up-todate information and reliability of transmission. The Customer agrees to bear full and exclusive responsibility arising from such risks and consequences of the usage of the Service.
- The Customer acknowledges that the Mobile Phone Number used to access the Service, may be used by ONESOON to request feedback from the Customer or to notify the Customer of new Services and Third Party offers. If the Customer does not wish to be contacted the Customer can notify ONESOON by texting STOP to the shortcode or by sending an email to Customer Care at support@onesoon.co.uk.
- The Customer acknowledges that the Mobile Phone Number used to access a Third Party product offer, may be used by ONESOON to request a callback to the Customer from the respective Third Party in relation to that offer. If the Customer does not wish to be contacted by any Third Party, the Customer can notify ONESOON by texting STOP to the shortcode or by sending an email to Customer Care at support@onesoon.co.uk.
- The Customer acknowledges that ownership of the auction data is retained by ONESOON and/or any original copyright holder. The Customer is granted permission to display such data on any mobile phone display on which the result was received as a direct result of using the Service. The Customer is not allowed to publish, copy or re-distribute any data from the Service to any third party.
Service provision
- ONESOON will make all reasonable endeavours to ensure the uninterrupted and timely supply of the service and will take all reasonable steps to correct any error, omission or mistake, but will be under no liability for any error in, or delay in, or failure of the service howsoever occasioned.
- ONESOON reserves the right to alter charges, instructions and methods of using the Service at any time.
- ONESOON reserves the right to suspend or terminate the Service if in their judgement they consider the Customer to be in breach of this agreement.
- ONESOON shall not be liable for damages resulting from delayed receipt or non-receipt of messages to the Service.
- ONESOON reserves the right to carry out alterations to the Service at any time.
- ONESOON reserves the right to disclose information about the Customer to regulatory or government bodies where the Customers actions have breached these terms and conditions or when ONESOON is required by law to disclose such information.
- To the fullest extent permitted by law, ONESOON disclaims all representations and warranties (express, implied and statutory, including but not limited to the warranties of merchantability and fitness for purpose, and non-infringement of proprietary rights) as to the Service and all information, products and other content (including but not limited to third party information, products and content) accessible from ONESOON.
- ONESOON shall not be liable for any damages whatsoever, including but not limited to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, or the cost of procurement of substitute goods and services.
- ONESOON shall adhere to the Data Protection Act 1998 and any other relevant legislation as amended from time to time. This applies, amongst other things, to the registration, storage and passing on of customer data.
Jurisdiction
This Agreement and the performance of all obligations hereunder shall be governed according to English law and the parties hereto hereby submit to the jurisdiction of the English Courts.
